Histori
Hooters, Inc. was founded in Clearwater, Florida, on April 1, 1983, by six Clearwater businessmen: Lynn D. Stewart, Gil DiGiannantonio, Ed Droste, Billy Ranieri, Ken Wimmer, and Dennis Johnson. That date is an April Fool's joke because six original owners believe their prospects will fail. Their first Hooters restaurant was built on a poorly purchased nightclub site. So many businesses were folded in that particular location that the founders of Hooters built a small "cemetery" at the door for every door that came and went before them. The first restaurant opened on 4 October 1983 in Clearwater. This original location is adorned with memorabilia from Waverly, Iowa, the hometown to some of the original Hooters 6.
In 1984 Hugh Connerty bought the rights to Hooters from Original Hooters 6. Robert H. Brooks and a group of Atlantic investors (operator Hooters of America, Inc.) bought Hugh Connerty. In 2002, Brooks bought majority control and became chairman. The Clearwater-based company maintains control of restaurants in the Tampa Bay Area, the Chicago metropolitan area, and one in Manhattan, New York, while all other locations are under the protection of Hooters of America, which sells franchise rights throughout the United States. Countries and international locations. Under the leadership of Brooks, the collective Hooters brand is expanded to over 425 stores worldwide. Brooks died on July 15, 2006, in Myrtle Beach, South Carolina, due to a heart attack. Brooks's will provide most of Hooters of America Inc. to his son Coby Brooks and his daughter, Boni Belle Brooks.

Chanticleer Holdings LLC, which has the right to block sales after a $ 5 million loan made in 2006, did so on December 1, 2010, a letter to the court. As a result, Chanticleer and other investors bought the company.

The rest of the Hooters Girls uniform consists of brown bag of restaurant tickets (or black ones with black uniforms), brown pantyhose, loose white socks, and clean white shoes. Legal issues
Legal history
In 1997, three people from the Chicago area sued Hooters after being denied work at the Orland Park, Illinois restaurant. Each of them was given $ 19,100. Four people who filed a similar lawsuit in Maryland received $ 10,350 each. This settlement allows Hooters to continue to attract customers with Hooters Girls female staff. The chain agrees to create other support work, such as the bartender and host, which must be filled regardless of gender.
In 2001, a judge ruled that Hooters of Augusta Inc. by deliberately violating the Phone Consumer Protection Act by sending unsolicited ad fax. The class action lawsuit, brought in June 1995 by Sam Nicholson, included 1,320 others who said they received an advertising fax from Hooters. Hooters of America Inc. which is headquartered in Atlanta, the local restaurant holding company, paid $ 11 million. The jury ruled that six faxes were sent to each plaintiff. With a $ 500 fine for each, which amounts to $ 3,000 per plaintiff.
Also in 2001, Jodee Berry, a waiter at Hooters in Panama City Beach, Florida won a beer sales contest, which the promised prize was a new Toyota car. However, the manager gave him a "Yoda toy" instead, claiming the contest was an April Fool's joke. Berry filed a lawsuit against Gulf Coast Wings, a local franchisee, and then reached a settlement.
In 2004, it was found that job applicants to a Hooters in West Covina, California were quietly filmed while undressing, pushing a civil suit filed against a national restaurant chain in Los Angeles Superior Court. The company handles the incident with additional employee training.
In 2009, Nikolai Grushevski, a man from Corpus Christi, Texas, filed a lawsuit because Hooters will not hire him as a servant. Grushevski and Hooters reached a secret settlement on 13 April. In September 2009, the US Cooperation Opportunities Commission filed a lawsuit against a chartered airline North Carolina (formerly Hooters Air, owned by Hooters of America) on behalf of Chau Nguyen, Asian aircraft officers fired three years earlier after complaining only white workers were promoted.
In May 2010, a lawsuit was filed against Hooters in Michigan after an employee was given a performance review of the work and was told that his shirt and short size could use some improvement by two women holding positions at headquarters in Atlanta. Michigan is the only country that covers height and weight as the limit for non-discrimination in hiring. Plaintiffs allege that women make a free gym membership offer and if she does not improve within 30 days, her work will be stopped. The company denied that they threatened to sack the plaintiffs, and the lawsuit was settled out of court.
In December 2010, as part of the settlement of Robert H. Brooks, a judge in Horry County, South Carolina approved the sale of Hooters of America Inc. to Wellspring Capital Management. The decision did not preclude Chanticleer Investors LLC based in Charlotte, North Carolina from exercising the "first right of refusal" given to Chanticleer in a loan agreement with Hooters.
In 2011, a number of former Hooters executives went to start the Twin Peaks franchise group. Hooters filed a lawsuit and charged that former Hooters executives stole trade secrets and management documents as part of their move to a new restaurant chain. In 2012 Kisuk Cha, an American Korean immigrant who placed a takeout order at Hooters in Queens, New York, sued the chain restaurant for racial discrimination after seeing a racial slurp printed on the cashier's receipt by a hostess who later confessed and then resigned. On April 2, 2015 (as a result of discrimination of racial discrimination Farryn Johnson) the case has not been resolved.
On April 2, 2015, former employee Farryn Johnson was awarded $ 250,000 after an arbitrator discovered that racial discrimination contributed to his termination. Johnson was dismissed in August 2013 after his store manager (from Hooters in Baltimore, Maryland) told him that he could not have the blonde highlights in his hair. Johnson filed a civil rights complaint with the Maryland State Civil Rights Division in which his lawyer declared the adoption of a dress code for African Americans and others (eg non-Hispanic, Hispanic/Latin American/Asian/Pacific American American) where a set policies relating to a particular group of people are regarded as racial discrimination. A statement by Hooters of America by Ericka Whitaker (senior manager of the Hooters of America brand) states that she has no problem having a blonde highlights as a Hooters Girl before becoming a brand manager and the company will continue to diversify its employees, from restaurants to the annual Hooters International Hockey Contest.
Legal status
Under labor discrimination laws in the United States, employers are generally allowed to consider characteristics that can be discriminatory if they are job qualifications (BFOQ). For example, a man's clothing manufacturer can legitimately advertise for a male model. Hooters believes the BFOQ defense, which applies when "the essence of business operations will be undermined if businesses abolish discriminatory policies".
Employee handbook requirements
An older version of the Hooters Employee Handbook (before October 2006), published in The Smoking Gun reads:
Customers can go to many places for wings and beers, but it is our Hooters Girls who make our concept unique. Hooters offers its customers an "All American Cheerleader, Surfer, Girl Next Door.
Female employees are required to sign that they "acknowledge and affirm" the following:
- My job assignment requires that I wear a designated Hooters Girl uniform.
- My job assignment requires that I interact with and entertain customers.
- The Hooters concept is based on female sex appeal and the work environment is a place where conversation is joking and entertaining is common.
